Calaveras County throws out the 2010 Mintier General Plan
Calaveras County denies CPC’s public records request for the Mintier General Plan. In the December 4 letter of denial the County states the one reason for the denial is “that the County no longer has a copy of the December 2010 Mintier General Plan.”
You can read the December 4 letter, a press release from CAP/CPC facilitator Tom Infusion, and his response to the denial in a testimony at the County Board of Supervisors meeting on December 8, 2015 on this website at https://calaverascap.com/planning-documents/general-plan-documents/
In denying the public records request, Assistant County Counsel David Sirias indicated that the County no longer has a copy of the Mintier General Plan. He further cited four additional reasons for denying the request:
- release of the document to me would result in a complete misunderstanding of the 2014 Draft General Plan
- it would discourage candid discussion within the agency.
- it would prematurely force the plan review process into the public arena
Finally, Mr. Sirias’ letter concludes that, “the County legally cannot comply with your request.”
On behalf of CAP/CPC Tom requested that the Board of Supervisors place this matter on the agenda as soon as possible, so that he can receive a copy of the Mintier General Plan. In the meantime, Tom willtappeal the Planning Director’s decision to the Planning Commission by the 15-day appeal deadline.
